Chapter 7
If your debt is substantial, you may be able to have many of your debts discharged, in exchange for the sale or liquidation of property you own. Under the new bankruptcy law, enacted in 2005, it is more difficult to qualify for a Chapter 7 bankruptcy. You must now submit to a “means test,” where the court determines whether you have the ability to enter into a repayment arrangement with creditors. If so, your only course of action is under Chapter 13.

It is important to work with an attorney, as some debts (such as tax obligations) may not be dischargeable in bankruptcy. Additionally, certain assets are exempt from sale under the bankruptcy laws.

Chapter 13
If you fail to qualify for the discharge of debts under Chapter 7, you can still seek relief under Chapter 13. Though you won’t be able to discharge your debt, you will still get immediate relief from the harassing letters and phone calls from creditors and collection agencies.
